Bonhab User Agreement

1. Acceptance of Terms

By accessing or using the Bonhab application ("Application"), you agree to be bound by these Terms of Service ("Agreement"), including all additional terms and conditions referenced herein. This Agreement constitutes a legal agreement between you and Bonhab ("Company," "we," or "us"). If you do not agree to these terms, you may not use the Application.

2. Description of Service

Bonhab provides an intelligent check-in solution designed specifically for enterprise teams, featuring advanced attendance tracking algorithms, automated attendance recording, real-time tracking capabilities, and intuitive dashboards for workforce management. The Service is intended to streamline attendance management processes for businesses operating in various work models, including office-based, hybrid, and remote work environments.

3. User Eligibility

The Service is available only to individuals who are 18 years of age or older and who can form legally binding contracts under applicable law. By using the Service, you represent and warrant that you meet these eligibility requirements. Businesses accessing the Service must ensure that all users are authorized representatives of the organization.

4. User Obligations

• You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to use the Service only for legitimate business purposes in accordance with this Agreement and applicable laws.
• You shall not attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.

5. Data Collection and Privacy

Bonhab collects and processes personal data in accordance with its Privacy Policy, which is incorporated into this Agreement by reference. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

Attendance data collected through the Service is owned by the enterprise customer, and Bonhab acts as a processor of such data pursuant to the customer's instructions.

6. Intellectual Property Rights

All intellectual property rights in the Application and Service, including but not limited to algorithms, software, text, graphics, logos, and trademarks, are owned by Bonhab or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes in accordance with this Agreement.

7. Service Availability and Maintenance

Bonhab endeavors to provide continuous access to the Service but does not guarantee uninterrupted operation. The Service may be temporarily unavailable for maintenance, updates, or other technical reasons. Bonhab will make reasonable efforts to provide advance notice of scheduled downtime when possible.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Bonhab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless Bonhab, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of this Agreement, or your violation of any rights of another party.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States of America and the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the federal or state courts located in California, and you consent to the personal jurisdiction of such courts.

11. Modifications to Agreement

Bonhab reserves the right to modify this Agreement at any time by posting the revised terms on the Application or providing notice to you through other reasonable means. Your continued use of the Service after such modifications constitutes your acceptance of the revised Agreement.

12. Termination

Bonhab may terminate your access to the Service at any time, with or without cause, upon written notice to you. Upon termination, all licenses and rights granted to you under this Agreement will immediately cease. Sections 5, 6, 8, 9, 10, and 13 shall survive termination of this Agreement.
